What does the CLT say about overtime?
First, it is important to understand what overtime is . According to the CLT, overtime is an excess of the normal working day, in which the employee performs company tasks.
By law, an employee's working hours cannot exceed 8 hours per day or 44 hours per week . If, by chance, they are exceeded, the employee must be paid for them.
According to article 59, the maximum number of overtime hours is 2 hours per day . However, the law allows up to 4 hours of overtime per day, provided that there is an agreement between the workers and the company and that this information is included in the contract.
Therefore, an extra day longer than 4 hours is not permitted by law, as it exceeds 12 hours of daily work.
Furthermore, in article 7, section XVI, the CLT provides for an increase of at least 25%. However, most companies establish a 50% salary increase for each hour of overtime , based on the value of the normal hour. However, depending on the day, time or written agreements, this amount may increase.
