As you probably already know because we have been reading and hearing about it everywhere for quite some time, the new European GDPR (General Data Protection Regulation) comes into force on May 25, 2018.
This has brought us all to the point of having to sweat coldly because failure to comply with this law can result in very large fines of up to 20 million euros or 4% of your business's annual turnover.
It's no small thing, not even a joke, is it? I don't know about you (you might be Mark Zuckerberg or Bill Gates and it doesn't matter to you), but if I get hit with one of these blows, I don't think I'll be able to straighten up for the rest of my life.
One of the points to be fulfilled in this new GDPR is to adapt all the forms on your website in such a way that you obtain the express and unequivocal consent of the person who subscribes to it to give you their data for the purposes that you have established in your privacy policy.
In other words, it is not worth assuming or simply putting a text saying that by sending the form they accept your privacy policy. They have to expressly indicate that they accept it and you have to have a record with proof that they have accepted it.
It sounds like something out of an Erin Brokovich-type lawyer movie that's off-putting, I know. But it is what it is.

As Raúl explained in the video in the previous section, to comply with the new general data protection regulation it is not enough to create a form with a box saying "I accept the privacy policy" but rather :
This box cannot be checked by default.
In addition to the checkbox, you must also have a legal text on all forms explaining certain legal details such as the person responsible, the purpose of using the data, the recipients where this data will be stored, etc.
Checking the box must be reflected in a personal record for you (usually stored in your email marketing tool) that allows you to demonstrate that each of your subscribers has effectively accepted your privacy policy.
